Information on data processing for the DGS websites
This data processing notice explains how DGS Diesel- und Getriebeservice GmbH (hereinafter referred to as “DGS”, “we” or “us”) as data controller collects, processes and uses your personal data when you visit the DGS websites available at www.dgs-mainz.com.
At DGS, we take our responsibility to protect your personal data seriously. In this Data Processing Notice, “personal data” means any information – alone or in connection with other information to which we have access – that relates to you as an identified or identifiable individual. We respect your right to privacy and will only process your personal data in compliance with applicable data protection laws. This data processing notice applies to information we collect when you use the DGS Web Sites and its features.
1. information on the collection and use of data
Each time you visit our DGS websites, we collect certain information. This information is used for the purposes listed below. The specific types of personal data we collect depend on your activities on the DGS websites. We also explain this in more detail below.
1.1 Automatically collected information
When using the DGS websites without registering, you do not have to actively provide any personal data; however, we automatically collect and process the following information: technical session and connection data, including the IP address of your device; your browser type; information about your device, hardware and software; user settings; websites you accessed directly before visiting the DGS websites; pages you view on the DGS websites, and the date and time of your visit.
We process and use the above information for the following purposes: (1) providing the DGS Web Sites and their functions; (2) improving the features and functions of the DGS Web Sites; (3) preventing and detecting misuse and malfunction of the DGS Web Sites, including troubleshooting.
This type of information is collected using, among other things, cookies. More detailed information on the types of cookies and their respective specific purpose can be found in section 2 below.
The processing and use of data is based on legal regulations that permit it, as (1) the processing is necessary for the fulfillment of the contract for the use of the DGS websites or (2) DGS has a legitimate interest in ensuring the functionality and error-free operation of the DGS websites as well as in adapting these websites to the requirements of the users.
1.2 User requests, account creation and registration
When you create a DGS-Webshop account, which is required for some parts of the DGS-Websites, we collect the following data provided by you as part of the registration process: first and last name, e-mail address, telephone numbers, field of activity, industry, name and type of your organization, address of the company.
The same data is processed when the user fills in the contact form on the website, for example to request technical information.
We process and use the above data for the following purposes: (1) verifying that you qualify for a DGS account and administering that account, (2) complying with the Terms of Use for the DGS Websites and any rights and obligations contained therein, (3) customizing the DGS Websites and its content to your needs, (4) communicating with you by sending technical information, updates, security notices, support and administrative messages, responding to your questions and inquiries, and providing customer service.
The processing and use of data is based on legal provisions that allow it because (1) the processing is necessary for the performance of the contract, including terms of use, for the DGS websites or (2) DGS has a legitimate interest in ensuring the functionality of the DGS websites as well as in adapting these websites to the needs of users.
If you create or register with a DGS account, we will use your login information (username and password) to provide you with access to and manage access to the DGS Web Sites and, if applicable, other online services through DGS or third parties that you may access through the DGS Web Sites. The information you enter during registration (username and password) will be processed to verify and confirm your authorization and to respond to any requests from you to reset your password.
1.3 Other services
You may be required to provide us with additional information when ordering additional services through the DGS websites. This may be a shipping address, payment information, etc. The collection and use of such additional information is subject to separate notices regarding data processing for the particular service.

We use cookies, a standard Internet technology, to store and retrieve login and other usage information for all users of DGS websites. “Cookies” are small text files that are stored by your web browser on your computer’s hard drive. They enable DGS to store user preferences, among other things. DGS websites use both session cookies and persistent cookies. Session cookies are temporary cookies that expire (and are automatically deleted) when you close your browser. Persistent cookies remain in your browser until they expire or until you delete them.
Cookies allow us to recognize your device (e.g., your laptop or mobile device) so that our DGS websites can be displayed in a format tailored to your device. Cookies typically do not identify you as an individual, only the device you are using. Performance/analytics cookies These cookies collect pseudonymized information about the web pages you visit.
These cookies collect information about how visitors use our DGS websites, such as which pages they visit most often and whether they receive error messages on those pages. These performance cookies do not collect any information that identifies you as an individual; all data they collect is aggregated and pseudonymized (among other things, we remove the last two octets of your IP address). We do not associate usage data collected by these cookies with personally identifiable information you may have provided when registering for a DGS account (such as your name).
On the DGS websites, we use “Google Analytics” – a service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”)to collect and store data regarding your use of the DGS websites in order to optimize the services and marketing of the DGS websites. From this data, usage profiles can be created under a pseudonym with the help of cookies.
Insofar as these data are to be considered personal data, their processing is based on legal regulations that permit such processing, since (1) DGS has a legitimate interest in adapting the DGS websites to the requirements of the users or (2) the data are used in pseudonymized form for optimization and marketing purposes and the user has not objected to this use. Third-party cookies: these cookies collect information for third parties.
We use external dynamic content to optimize the presentation and offer of our website. When visiting the website, a request is automatically made to the server of the respective content provider via API, during which certain log data (e.g. the user’s IP address) is transmitted. The dynamic content is then transmitted to our website and displayed there.
We use external content in connection with the following functionalities:
Google Maps
We use the map service “Google Maps” from Google to provide you with an interactive map. When displaying the map, data including your IP address and your location are transmitted to Google servers in the USA and stored there. This processing is carried out on the basis of our overriding legitimate interest in optimal marketing of our offer in accordance with Art. 6 (1) f) DSGVO.

3. contact forms, subscription to newsletters and other marketing communications.
DGS websites may offer you the opportunity to subscribe to a newsletter or other marketing communications sent to you by email. For this purpose, we process and use your name and email address to provide you with the newsletter and other communications to which you subscribe. The type of newsletter depends on the type of company and type of machine selected in the registration form.
The processing and use of personal data for the purpose of subscribing to newsletters and other marketing communications is based on (1) legislation that allows it, as the processing of the relevant data is necessary to provide the subscription (Art. 6 (1) b) DSGVO) or (2) with your consent.
To confirm your subscription and consent, we use the double opt-in procedure. We store your confirmation for documentation and proof of your subscription/consent. You have the right to cancel your subscription/revoke your consent at any time without incurring any costs, apart from the transmission costs according to the basic tariff. Unsubscribing from the newsletter/revoking your consent will not affect the lawfulness of the data processing based on your consent before unsubscribing/revoking.
4. Ordering brochures and other advertising material
You can order brochures and – in connection with specific applications and services made available via the DGS websites – other promotional materials on our DGS websites. We process and use the information you provide (such as your name, address, other contact information, and the brochure you select) to fulfill your order and send you the materials in the manner you request (via e-mail, by mail, etc.).
The processing and use of personal data for these purposes is based on (1) legislation that allows it, as the processing of the relevant data is necessary to deliver the orders or (2) your consent. You have the right to withdraw your consent at any time. The revocation of your consent does not affect the lawfulness of the data processing based on your consent prior to the revocation.
5. data exchange within the DGS group
DGS is a global company based in Germany and part of the DGS Group. The data you provide to us when registering for a DGS account (see section 1.2 above) is stored in our centralized customer database in Germany and shared within the DGS Group for the purpose of managing your business relationship with DGS and the DGS Group.
The exchange and use of this data is based on legal provisions that allow it because (1) the processing is necessary for the performance of the contract including terms of use for the DGS websites or (2) DGS has a legitimate interest in sharing this data within the DGS Group for internal, administrative purposes.
The processing of DGS account information related to you could take place outside the control of your local jurisdiction and the European Economic Area in the following countries: for example, USA, Russia, Belarus. If we are required by applicable data protection law in your local jurisdiction not to transfer your personal information outside the sphere of influence of your local jurisdiction, we will take appropriate steps to ensure compliance with such law.
Any transfer of your personal data to third countries (i.e., countries that are not members of the EU/EEA) will continue to be in compliance with all applicable data protection laws.
If data protection in a third country is not recognized as adequate by the European Commission or your local jurisdiction, DGS will take appropriate steps to ensure adequate protection of your data; for example, by entering into EU Commission standard contractual clauses for data transfers with recipients in third countries that provide for appropriate safeguards. Data exchange outside the DGS Group
In order to provide certain applications and services, we transfer your data to certain third parties who provide services to us. We may work with third parties who provide or enable services for us, such as newsletter service providers, IT providers, web hosting providers, as well as other service providers who act as data processors and therefore process data for us in accordance with our instructions. These third parties are prohibited from using your personal data for their own commercial, promotional or other purposes other than those explicitly agreed upon. They are required to follow our explicit instructions and comply with appropriate security measures to protect your personal data.
We may disclose personal information if we are otherwise required to do so as part of an ongoing legal proceeding, pursuant to an injunction, by law or under applicable law, rule or regulation.
6. detection and prosecution of misuse
We store usage data including IP addresses for the purpose of detecting and, if applicable, prosecuting misuse of the DGS websites. If data is not needed for law enforcement purposes, it is usually deleted after seven days. Data storage and use is based on legal regulations that allow it, because (1) the processing is necessary to fulfill the contract including terms of use for the DGS websites or (2) DGS has a legitimate interest in ensuring the functionality and security of the DGS websites.
7. deletion of data
In general, we delete personal data as soon as it is no longer necessary for the purposes for which it was originally collected or processed. If the processing is based on your consent and you revoke it, we will delete your personal data immediately after revocation, unless we are required by law to store the data.
DGS sends an annual reminder notice to all registered users, asking them to reconfirm the information they provided when registering for their DGS account. If the respective user does not confirm their account information, the account will be deactivated. DGS will delete the DGS Account and related data one year after deactivation if the confirmation by the User is not made.
8. other services, applications and websites
You may access other services and applications through the DGS websites, the use of which personal data is explained in separate privacy information documents. Our DGS websites also contain links to other websites. DGS bears no responsibility for the use and protection of personal data on these other sites. Please be aware when you leave our DGS websites and read the privacy information documents of the other websites.
9. your rights
You generally have the right, in accordance with applicable data protection laws, to obtain from DGS information about your personal data, to correct it, to delete it, or – if applicable – to restrict or object to the processing of such data insofar as it concerns you, and to exercise your right to data portability.
